The Oregon Contractors board recommends that down payments be limited to 10% of the total on all contractor contracts. We find this reasonable..

However, we all know that HD requires 100% payment in full before the contract is processed.

Most reputable window companies have open accounts with their suppliers so there is no way the down payment is going to go where you think it is going.

I myself get material cost up front. I've been burned for $20K in fifteen years. From bad checks, credit card issues and the Mr. Nice Guy "I'll carry you 30 days. No More for me. I have accounts with all my suppliers. I have to pay in 30 days if I want materials. If customers don't pay me it's out of my pocket. I've practiced that rule for five years and have had no issues. I also use my two brothers Guido and Ramone for collections. They always come through with flying colors!!!

We require 50% down as well. The windows for your home are being custom made. If you were to change your mind or, God forbid, be killed in an accident prior to installation, your contractor would be stuck with the windows.
If you order granite countertops or just about anything else that is custom manufactured to your specifications, they will also require a deposit of at least 50%.

Lou, it works this way. My salesperson brings me 50% down stroke and he gets his 30% commission check right now. Otherwise he waits and gets paid when I get paid. Get it?

We ask for and get, or walk form the job, 40% upfront, 40% when we say the job is done and 20% when the customer says the job is done.

The Better Business Bureau also recommends that no more than 10% be given as a down payment.

We are members of the BBB, without a single complaint in 15 years. When we asked our local BBB about this issue, about a year and a half ago, we were told that since our business requires having windows custom made to fit the customer's house, the 10% rule did not apply to us.
I would check with your local BBB, and let them know the full story, before you run with the 10% story.

I guess that's why the BBB doesn't sell/install very many windows.

If one really thinks this issue through, logically, they realize that it's in everyone's best interest for the customer and vendor to cover their risks and we believe 40% with order, 40% upon installation and 20% upon acceptance does just that.

Did business (not windows) in Oregon for 20 years, ending about 5 years ago. My first 10 years were good (extremely good), but Oregon became so left-leaning that it was impossible to offer products/services at reasonable prices.

IF the BBB is making recommendations like the one you mention, that's just one more example of the silly environment that Oregon has created for itself.

This comes down to a trust issue. Good faith and "committment" from both parties is proper and fair. If a dealer has committed to a schedule... the homeowner should also with a deposit. If the dealer has ordered custom (non-returnable) materials for a homeowner's benefit... the homeowner should cover the cost prior to purchase (typically 20-40%). In most cases it is the dealer that carries the trust for the remainder of the job so progressive payments are not unusual. Final payment should be substantial enough to inspire the dealer to complete the project in a timely and professional manner... that's his/her profit dollars. When they do... they deserve to be paid promptly. Just my opinion.
